These Terms of Service ("Terms") set the rules for using the Fixovio app for drivers and the related services. They are the terms of service (regulamin) required by Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.

This document is a translation of the official Polish text, which is the binding version. In the event of any discrepancy, the Polish text prevails.

1. Who we are

1.1. Fixovio is operated by SABTECH spółka z ograniczoną odpowiedzialnością, ul. Góralska 5, 53-610 Wrocław, Poland, entered in the register of entrepreneurs of the National Court Register (KRS) kept by the District Court for Wrocław-Fabryczna in Wrocław, VI Commercial Division of the KRS, under number 0001271091, NIP 8971980459, REGON 545903540, share capital PLN 5,000.00 ("Fixovio", "we", "us").

1.2. You can contact us at contact@fixovio.pl or by post at the address above. The email address is also our single point of contact for users and for authorities under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act, "DSA"). We communicate in Polish and English.

2. Definitions

  • App – the Fixovio mobile app for drivers (iOS and Android).
  • Fixovio Biz – the separate app and website for workshops, governed by the Business Terms.
  • Service – everything we provide to you through the App, as described in section 3.
  • User or you – anyone using the Service, with or without an Account.
  • Guest – a User without an Account.
  • Account – your registered user account.
  • Consumer – a natural person using the Service for purposes not directly related to their business or profession. The consumer-protection rules in these Terms also apply to a natural person running a sole business (osoba fizyczna prowadząca jednoosobową działalność gospodarczą) who concludes a contract directly related to that business where, as shown in particular by the subject of their business recorded in the Central Register and Information on Business Activity (CEIDG), the contract is not of a professional nature for them.
  • Workshop – a business (trader) offering car repair or maintenance services that is listed in the App.
  • Listing – a Workshop's public profile in the App.
  • Booking – a reservation of a time slot for a service at a Workshop, made through the App.
  • Car check – the questionnaire in the App, with an optional engine-sound recording, that gives guidance on urgency and the kind of service needed.
  • Visit report – the information a Workshop may record after a visit about what it found and did (section 9.10).
  • Content – anything Users or Workshops publish or send through the Service: reviews, photos, replies, descriptions, notes, reports and recordings.

3. What Fixovio offers

3.1. Through the App you can:

  • find Workshops on a map or list, filter and compare them, and view their Listings, services, starting prices, opening hours, photos and reviews;
  • book visits at Workshops, and change or cancel them under the Workshop's rules;
  • run a Car check;
  • optionally share engine recordings to help improve our sound analysis (section 8);
  • review Workshops after a completed visit;
  • save favourite Workshops;
  • store your vehicles and get reminders about insurance, technical inspection and oil changes;
  • receive notifications about your Bookings and your Account.

3.2. The Service is free of charge for drivers. We do not take payments from drivers. You agree the price of a repair with the Workshop and pay it directly to the Workshop.

3.3. Fixovio is an intermediary. We provide the technology that lets you find and book Workshops. We are not a party to the contract between you and a Workshop, we do not perform repairs, and we do not set, collect or guarantee prices. Each Workshop is an independent business and is solely responsible for its services, prices, quality, warranties and invoices.

3.4. All Workshops on Fixovio are businesses (traders). When you use a Workshop's services as a Consumer, EU and Polish consumer law applies to your contract with that Workshop, and the Workshop, not Fixovio, is responsible to you under it. Each Listing shows the Workshop's legal name and tax ID (NIP).

3.5. Prices shown in Listings are the Workshop's own starting prices ("from"). The final price is agreed with the Workshop.

4. Technical requirements

4.1. To use the App you need: a smartphone with iOS 15 or later or Android 7.0 or later; an internet connection; and, for an Account, an email address or an Apple or Google account.

4.2. Some features need device permissions that you can give or refuse at any time in your phone's settings: location (to find nearby Workshops), camera and photos (for your avatar and review photos), microphone (for engine recordings) and notifications. The App works without them, with fewer features.

4.3. We may require you to update the App to the latest version to keep using it, for example for security reasons.

4.4. Using the internet involves general risks, such as malware, phishing or unauthorised access to your device. Keep your device and its software up to date. We will never ask you for your sign-in code by phone or email.

5. Using Fixovio without an Account

5.1. As a Guest you can browse Workshops, read reviews, run a Car check and report Content. You need an Account to book visits, write reviews, save vehicles and favourites, and receive notifications.

5.2. A Guest's Car check result can be opened by anyone who has its private link. Do not share the link if you do not want others to see it. Guest Car checks are deleted after 30 days.

6. Your Account

6.1. You must be at least 18 years old to create an Account and use the Service.

6.2. You can sign up with Sign in with Apple, Sign in with Google, or your email address and a one-time code. Accounts with the same email address are linked automatically.

6.3. When signing up you confirm that you are at least 18 and accept these Terms, and you acknowledge that you have been provided with the Privacy Policy. Marketing consent is optional and separate.

6.4. Give true information, in particular your name and phone number, which Workshops see when you book. Keep your device and email account secure, because anyone with access to them can sign in as you. Tell us at contact@fixovio.pl if you suspect misuse of your Account.

6.5. An Account is personal. You may not let others use it, sell it or transfer it.

6.6. You can use the App on behalf of a business (for example, to book service for company cars). In that case you confirm that you may act for that business, and the provisions of these Terms that protect Consumers do not apply, except as stated in the definition of Consumer.

7. Car check

7.1. The Car check gives general guidance, not a diagnosis. It is based on your answers and, if you record the engine, on an automated analysis of the sound. It may be incomplete or wrong, and it does not replace an inspection by a qualified mechanic.

7.2. The urgency levels ("Stop driving", "Get it checked soon", "Can wait", "Needs a diagnosis") and suggested service categories come from fixed rules applied to your answers. If you are unsure whether your car is safe, do not drive it. In an emergency call 112.

7.3. Sound analysis. If you record the engine, a small machine-learning model on your phone classifies the sound (for example, normal idle or a possible battery, ignition, oil, power-steering or belt problem) and shows a confidence level. The recording is analysed on your phone; only the result is sent to us, unless you choose to share recordings (section 8). Results are labelled as automated.

7.4. You decide what to do with the Car check result. To the extent permitted by law, we are not responsible for decisions you take based only on the Car check, such as driving or not driving the car, or for the condition of the car. Nothing in these Terms limits liability that cannot be excluded by law.

7.5. If you attach a Car check to a Booking, the Workshop sees it.

8. Sharing engine recordings (optional)

8.1. Before your first recording we ask whether you agree to share your engine recordings with us. Sharing is optional: the Car check works the same either way. The consent dialog explains what we keep, why and for how long. The Privacy Policy has the details.

8.2. Shared recordings may contain voices or other sounds nearby. Please record without people talking near the phone, and do not record other people without their knowledge.

8.3. You can stop sharing or delete your recordings at any time in Settings or by writing to contact@fixovio.pl. When you delete recordings, stop sharing or delete your Account, we delete the original recordings or turn them into effectively anonymous versions. Anonymous versions contain no voices and no link to you.

8.4. Licence. To the extent you hold any rights in a shared recording (in particular the related rights of a phonogram producer), you grant Fixovio a free, non-exclusive, worldwide licence, without time limits other than those stated below, in the following fields of exploitation: (a) fixing and reproducing the recording by any technique, including digital and magnetic recording; (b) entering it into computer memory and networks and storing it; (c) analysing, editing, cutting, filtering and anonymising it, including creating derivative versions; (d) using it, and versions created from it, to train, test and develop software and machine-learning models and to develop products and services. The licence in points (a)–(d) applies for as long as the original recording is lawfully retained. For effectively anonymous versions, the licence also covers (e) making them available, lending and licensing them to third parties, and Fixovio may grant sublicences for this purpose. You may withdraw your consent to further sharing at any time (section 8.3); this does not affect anonymous versions already created.

9. Bookings

9.1. How booking works. You choose a service, a day and a time from the Workshop's availability, optionally add your vehicle, notes and a Car check, and confirm. You must be signed in to confirm.

9.2. Depending on the Workshop:

  • instant booking – the Booking is confirmed immediately;
  • request – the Workshop must accept it. If it does not answer within its request window (24 hours by default), the request expires. If the Workshop proposes another time, the request stays open while you decide, until shortly before the proposed time;
  • walk-in – the Workshop cannot be booked in the App; visit it directly.

9.3. The Workshop sees your name, phone number, the vehicle, your notes and any attached Car check. It uses them to prepare your visit.

9.4. Each Workshop sets its own booking rules, shown on its Listing and in the booking flow: how far in advance you can book (60 days by default), the minimum lead time (60 minutes by default), the cancellation cut-off, the request window, and how many Bookings you can make with it per day (2 by default). You can have up to 10 open Bookings at a time.

9.5. A confirmed Booking is a reservation of a time slot. The contract for the repair or service itself is concluded between you and the Workshop, usually at the Workshop, and its terms (price, scope, warranty) are agreed with the Workshop.

9.6. Cancelling. You can cancel a confirmed Booking in the App until the Workshop's cancellation cut-off (by default, 2 hours before the start time). After the cut-off, contact the Workshop directly. You can withdraw a request that the Workshop has not yet confirmed at any time.

9.7. Changes by the Workshop. The Workshop may propose a new time; you can accept it or keep the original time. The Workshop may also cancel a Booking, and we will notify you. We are not responsible for a Workshop's cancellations or delays, but you can tell us about repeated problems.

9.8. Missed visits. A Workshop may mark a Booking as missed if you do not arrive. Fixovio does not impose any penalty or fee for missed visits.

9.9. A Booking is marked as completed when the Workshop completes it or, at the latest, 24 hours after its end, unless it was cancelled or marked as missed. We send a reminder about 24 hours before the visit.

9.10. Visit reports. After the visit, the Workshop may record in Fixovio Biz what it found and did (for example the part of the car, the result, how urgent it was, a short note and the final price). We keep this with the Booking and use it to check and improve the accuracy of the Car check and the sound analysis, as described in the Privacy Policy. A Visit report is not a review and is not published.

10. Reviews

10.1. Who can review. Only the driver who booked a visit through the App, only after the visit is completed, only once per Booking and within 60 days after the visit. This is how we verify that reviews come from people who actually used the Workshop's services after a visit booked through Fixovio. We do not check or edit the content of reviews before publication. We use technical limits against abuse (for example, limits on the number of requests), which do not assess what a review says.

10.2. A review has an overall rating (1–5 stars), optional ratings for quality, price and punctuality, optional text and up to 3 photos.

10.3. Reviews are public. They show your first name and the first letter of your last name (for example "Jan K.").

10.4. Reviews must be honest, based on your own experience, and follow the Community & Review Guidelines. Reviews must not be paid for, rewarded or written for or against a Workshop by anyone connected with it.

10.5. Workshops cannot delete reviews. They can publish one public reply per review and report a review that breaks the rules. Only Fixovio can remove a review, after a report and a review by a person (section 13).

10.6. Reviews are shown newest first. A Workshop's rating is the arithmetic average of its published reviews and is recalculated when a review is removed. Payment by a Workshop has no influence on reviews.

10.7. If you delete your Account, your reviews stay published under "Former customer", without your name, and their photos are deleted.

11. Your Content and the licence you give us

11.1. You are responsible for the Content you publish or send. You confirm that you have the rights to it, and that it does not infringe the rights of others (for example, copyright or the image of people shown in photos).

11.2. For Content other than recordings (section 8), you grant Fixovio a free, non-exclusive, worldwide licence, with the right to grant sublicences to our service providers to the extent necessary to provide the Service, in the following fields of exploitation: storing, reproducing by any technique, entering into computer memory and networks, displaying and making publicly available in such a way that anyone can access it at a place and time of their choosing, in the Service and in materials about the Service, and adapting it (for example, resizing or cropping). The licence lasts as long as the Content is published and, for reviews, also after your Account is deleted (section 10.7).

12. Rules of use

12.1. You must not use the Service to provide unlawful content, or in a way that breaks the law, these Terms or good practice. In particular, you must not:

  • publish false, misleading or fake reviews, or manipulate ratings;
  • harass, threaten, insult or discriminate against anyone;
  • publish other people's personal data (such as phone numbers, plates or addresses) without a legal basis;
  • make fake Bookings or Bookings you do not intend to keep;
  • impersonate anyone or create Accounts for others;
  • send spam or advertising;
  • send malware, overload or attack the Service, bypass its limits or security, or access it with bots or scrapers;
  • copy, decompile or reverse-engineer the App, except where the law allows it;
  • submit reports or appeals that you know are unfounded.

12.2. The Community & Review Guidelines describe these rules in more detail and are part of these Terms.

13. Reporting content, moderation and appeals

13.1. Reporting. Anyone can report a Listing, a Workshop photo or description, a review or a Workshop's reply using the report button. Without an Account you give your name and email. When you report illegal content, explain why you think it is illegal and confirm that your report is accurate and made in good faith. You get a confirmation with a reference number.

13.2. How we decide. Every report is reviewed by a person. We do not use automated content moderation. We may keep the Content, or remove it or restrict access to it (for a Listing: suspend the Workshop). We decide all open reports about the same Content together.

13.3. Statement of reasons. We tell the reporter and, if we remove or restrict Content, the person who published it, what we decided and why, whether the decision was based on the law or on these Terms, and how to contest it.

13.4. Other measures. For serious or repeated breaches we may suspend or terminate an Account (section 17). If someone repeatedly submits clearly unfounded reports, we may stop processing their reports for a reasonable period after a prior warning.

13.5. Appeals. You can contest our decision within 6 months from the button in the decision message in the App, or by replying to the decision email. A person reviews the appeal, where possible someone who did not take the original decision, and we reply with reasons.

13.6. Other options. You can also refer the dispute to a certified out-of-court dispute settlement body under Article 21 of the DSA (the European Commission publishes the list), or go to court.

14. How Workshops are ranked

14.1. Only Workshops with an active Fixovio subscription are listed, including a subscription in a free period granted under a promotional code. Every listed Workshop pays the same subscription price. Payment does not affect the order of results: there are no paid or promoted positions.

14.2. Default order ("Relevance"). Results are ordered by a score made of three parameters, in this order of importance:

  • match with the service categories you selected (the most important: 3 points for each selected category the Workshop offers);
  • the Workshop's average rating (1 point per star);
  • distance from you or from the map area (minus 1 point for every 2 km).

14.3. You can also sort by distance (nearest first, then rating) or by rating (average rating, then number of reviews), and filter by categories, "open now", "free slot today", minimum rating and name. "Open now" and "next free slot" are shown on Listings but do not change the order unless you filter by them.

15. Notifications and messages

15.1. We send you messages about your Account, Bookings and important changes to the Service (service messages) in the App, by push notification and by email. You can switch off some of them in Settings, but not messages that are essential for your Account or your rights.

15.2. We send news and offers only if you agree to it (marketing consent). You can withdraw that consent at any time in Settings or with the link in every such email.

16. Vehicles and reminders

16.1. Reminders about insurance (OC), technical inspection and oil changes are calculated from the dates and mileage you enter. They are a convenience. Meeting your legal obligations as a car owner remains your responsibility.

17. Duration and termination

17.1. The contract for the Service is concluded when you create an Account and lasts for an indefinite period. Using the App as a Guest is a contract for single uses that ends when you stop using the App.

17.2. You can end the contract at any time, without giving reasons, by deleting your Account in the App (Account → Privacy & data → Delete account) or by writing to contact@fixovio.pl from your Account's email address. Deletion in the App takes effect after a 7-day grace period, during which you can cancel it by signing in. This does not affect your right to erasure under Article 17 of the GDPR. If you have upcoming Bookings, or own a Workshop with an active subscription, the App shows what to resolve first. If you request deletion by email, we complete the request without undue delay and within one month at the latest (this period may be extended under Article 12(3) GDPR; we will tell you if so).

17.3. We may end the contract with 30 days' notice by email for an important reason: the Service is permanently discontinued or substantially changed, we are required to do so by law or by an authority, or your Account has been inactive for more than 3 years.

17.4. We may suspend or end your Account immediately if you seriously or repeatedly breach these Terms or the law, in particular by publishing illegal content, fake reviews, fraud, attacks on the Service or repeated fake Bookings, or if you are under 18. We tell you the reasons, and you can appeal (section 13.5).

18. Right of withdrawal (Consumers)

18.1. As a Consumer you may withdraw from the contract for the Service within 14 days of concluding it, without giving reasons and at no cost. You can do so by deleting your Account or by sending us a statement, for example using the model form in the Annex, to contact@fixovio.pl or to our postal address. Sending the statement before the deadline is enough.

18.2. Withdrawal is free, because the Service is free. Your Bookings with Workshops are separate arrangements with the Workshops.

19. Availability and changes to the Service

19.1. We try to keep the Service available at all times, but there may be breaks for maintenance, updates or reasons beyond our control. Where possible we announce planned breaks in advance.

19.2. We may develop, change or remove features for the reasons listed in section 24.1, at no cost to you. If a change significantly and negatively affects your access to or use of the Service, we tell you in advance on a durable medium (email), and if you are a Consumer you may terminate the contract free of charge within 30 days of the change or of being informed of it, whichever is later.

19.3. If you are a Consumer, we are responsible for the Service being in conformity with the contract, as provided in the Polish Consumer Rights Act of 30 May 2014. You have the statutory rights and remedies provided by that Act if the Service is not in conformity with the contract.

20. Liability

20.1. We are responsible for performing our own obligations under these Terms in accordance with the law.

20.2. Because we are an intermediary, and except to the extent required by applicable law, we are not responsible for:

  • the services, repairs, prices, quality, warranties, invoices or conduct of Workshops;
  • the accuracy of information published by Workshops (services, starting prices, opening hours, photos);
  • Content published by other Users, unless we had actual knowledge of its illegal nature and did not act promptly to remove it;
  • decisions you take based only on a Car check or reminder (sections 7.4 and 16);
  • breaks in the Service caused by events beyond our reasonable control, or by your device or internet connection.

20.3. If you are not a Consumer, our liability is limited to damage caused intentionally, and does not cover lost profits.

20.4. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, in particular for damage caused intentionally or for personal injury, or the rights of Consumers under mandatory law.

21. Complaints

21.1. You can make a complaint about the Service by email to contact@fixovio.pl, or by post to our address. Please describe the problem and what you expect, and give the email address of your Account.

21.2. We answer complaints within 14 days of receiving them, by email or in the way you made the complaint.

21.3. Complaints about a repair or a Workshop's service should be made to the Workshop. You can also tell us about them, for example if a Workshop seriously breaks our rules.

21.4. Complaints about content moderation decisions follow section 13.5.

22. Out-of-court resolution of consumer disputes

22.1. As a Consumer you can use out-of-court ways of resolving complaints and disputes, for example the help of your municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów), the Trade Inspection (Inspekcja Handlowa), or other entities in the register kept by the President of the Office of Competition and Consumer Protection (UOKiK), available at uokik.gov.pl. If we reject your complaint, we will tell you whether we agree to take part in such a procedure.

23. Personal data

23.1. Fixovio is the controller of your personal data. How we process it, and your rights, are described in the Privacy Policy.

24. Changes to these Terms

24.1. We may change these Terms for important reasons: a change of law or of an authority's decision; new, changed or removed features; changes needed for security or to prevent abuse; or a change in how we provide the Service.

24.2. We tell you about changes at least 14 days before they take effect, in the App and by email. If you do not accept the new Terms, you can terminate the contract by deleting your Account before they take effect. After they take effect, the App asks you to accept them before you continue.

24.3. Changes required by law or an authority may take effect sooner if the law requires it.

25. Law, courts and language

25.1. These Terms are governed by Polish law. If you are a Consumer, this does not deprive you of the protection given to you by the mandatory rules of the country where you have your habitual residence.

25.2. Disputes with Consumers are decided by the court competent under the general rules. Disputes with Users who are not Consumers are decided by the court competent for our registered office.

25.3. These Terms are available in Polish and English. The Polish version is binding.

26. Final provisions

26.1. If any provision of these Terms is found invalid, the rest remains in force.

26.2. These Terms are made available free of charge in the App (Account → Help → Legal) and at app.fixovio.com, before and after you conclude the contract, in a way that allows you to obtain, reproduce and record them (save or print). Earlier versions are available on request.

26.3. These Terms take effect on 10 November 2026.
